This Privacy Policy applies to the services of RENT BETTA LLC (“RENT BETTA”, “we”, or “us”), which operates the website RENTBETTA.com (our “Site”) and related websites, mobile applications and services that help renters find and rent an apartment (collectively, our “Services”). This Privacy Policy describes the information we collect, how we use it, and how we share it. If there are any terms in this Privacy Policy you do not agree with, please discontinue the use of our Services immediately.

2. Information We Collect

  1. Information you submit to usWe collect and store information you submit to us through the use of our Services.This includes personally identifiable information when you Sign Up to use our website, such as your name, email address, phone number, and work address.When you click Book a Tour or Apply Now and complete additional pop-ups on our Site, the data you submit is also collected and stored by us, including your desired move-in date and any apartment preferences you may include in a message field.If you submit a rental application through us, the information on the application, including your name, social security number, payment data (eg, credit card or bank account information), residence history, employment history, and other personal information included on the application is collected and stored by us, and transmitted to the user who represented themselves as the landlord or property manager for the apartment you are applying for.For users who register as property managers or investors, we collect the information requested on the pop-ups associated with those categories, including the company you work for, your company’s web address, your work email address, desired investment amount, investment preferences, accredited investor status and information supplied to verify your accredited investor status (including documents you upload such as tax returns, CPA letters, or bank and brokerage statements).For users asked to verify their identity, the information provided on their identity documents (typically a driver license or passport) is collected and stored. This includes, but is not limited to, the type of document used, name, date of birth, address, picture on the document, and any unique identifiers of the document.If you make a payment to us, including for listing an apartment, we collect details associated to process that payment, including but not limited to the name on your credit card, the security code, and your zip code. The full credit card number is stored and processed by our third party service provider, Stripe, and is subject to their privacy policy.In general, any information you submit to us, whether through a pop-up, a rental application, the registration or Sign Up process, an email, or other means you may use to communicate with us, is information we collect and store.
  2. Information collected via technology In addition to the information you submit to us, we also collect information passively via technology when you use our Services.This technology includes cookies, web beacons, and pixel tags, and is often handled by third party providers.Cookies.   3. Information collected from other sources We may collect additional information about you from external sources, and we commonly do this to verify your identity. This information may include the personal names, legal names, and addresses of owners or officers of buildings within New York City.We may receive additional information from third party service providers to verify your identity. For example, Stripe may provide us with information such as your name and zip code from the credit card you use. Other third party service providers may provide us verification information (such as a risk score or year first seen) regarding the name, email, phone number, and other data fields you provide to us. Our efforts to verify users are intended to reduce fraud and the illegitimate use of our Services.We may collect personal information about you from other sources and third parties when you apply for an apartment. For example, if you apply for an apartment through us, we may receive the records generated by third party background checks, such as credit profiles and criminal histories.

3. How We Use Your Information

We may use or disclose your information for the following purposes:

  1. To manage user accounts, including activating, verifying, and monitoring activity of user accounts, and providing password resets
  2. To post testimonials on our Services, if you consent to use your name and the content of your testimonial
  3. To fulfill the reason for which you provided the information, such as providing a third party property manager with the information they require from potential viewers when booking a tour for an apartment, or for submitting a rental application. This information typically includes your name, email, phone number, move-in date, and any text you include in a message field
  4. To provide you with email alerts and notices concerning our Services, such as email notifications regarding new apartments or price changes on apartments you previously saved
  5. To send you marketing or promotional communications, either directly from us or from our third party marketing partners. You can opt-out of marketing emails at any time in the footer of the email
  6. To improve our Services, by finding and reducing bugs or crashes in our software, improving the readability of our Site layout and its content, monitoring the speed and reliability of our Services, and similar activities
  7. For testing, research and product development, such as improving or confirming the ease, usability, and reliability of our Services
  8. To protect the integrity of our Services, such as investigating or preventing fraudulent activity on our Site. For example, we may verify identities to reduce apartment listings by people who are not the rightful owners or property managers of those apartments. We may also provide personal information of users who we suspect are engaged in fraudulent activity to law enforcement
  9. To respond to law enforcement requests as required by applicable law, court order, or government regulations
  10. To enforce our terms, conditions and policies
  11. To establish, exercise, or defend our legal rights
  12. To defend or further our legitimate business interests
  13. To defend or exercise legal rights for the legitimate interests of our users
  14. To communicate with third-party property managers or landlords regarding the interest their apartments are generating on our Services, and the renters they attract through us
  15. To respond to user inquiries or offer support
  16. To notify you about important changes to our Services, such as updates to this Privacy Policy

4. How We Share Your Information

We may share your personal information with third parties as described in “How We Use Your Information”, or for any other purpose that has been notified to you or for which you have consented. We may release personally identifiable and other information:

  1. To our service providers, including outsourced analytics providers or engineering teams who help us with our business operations
  2. To comply with our legal operations or in connection with legal claims
  3. To property managers and landlords who have apartments listed on our Services
  4. In connection with any corporate merger, consolidation, restructuring, financing, sale or transfer of ownership of all or part of RENT BETTA, including transaction due diligence

5. How Long We Will Keep Your Information

We will keep your information as long as necessary to fulfill legitimate business interests, such as communicating with property managers and landlords regarding interest for their apartments listed on our Services. This includes the name and other personal information of users who have booked a tour or applied for an apartment on our Services. We will attempt to anonymize your name and other personal information in our databases and communications with third parties 120 days after the deletion of your account.

6. Security

We choose industry leading security practices and take reasonable steps to protect your personal information. We host our data on Amazon Web Services and Google Cloud Products servers in the U.S., force HTTPS on all connections, and use firewall rules to secure access. Despite our safeguards and efforts, no transmission of information over the Internet or its later storage is 100% secure, and we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security measures and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, your use of our Services and transmission of your personal information over the Internet is at your own risk, and we have no liability for disclosure of personal information due to errors in transmission or unauthorized acts by third parties. We recommend you only access our Services over a secure connection, avoid public computers in favor of your own computer or mobile phone, and use a VPN whenever you are on public wi-fi.

7. Listings

If you list an apartment on our site, any information you include in the listing will be publicly available on the Internet. You should not include your direct contact information (eg, your phone number or email) in the listing to prevent unsolicited calls or emails.

8. Third Party Analytics

We use third party analytics software, including offerings from or similar to those by Adobe Analytics, Crazy Egg, DataDog, Google Analytics, Heap, HotJar, and MixPanel, to better understand and analyze how customers use our Services. Information generated by these third parties (including your IP address and an activity log of your interactions with our Services) is transmitted to and stored by these third parties to help us better understand, monetize, and improve our Services.

9. Third Party Content and Applications

Our Services may include third party content and applications, for example, social logins that allow you to login with Facebook, Google, or Apple to expedite the registration process. These third parties share your personal information with us, including your name and email address, which we collect and store. If we discontinue the use of a third party service or application, like a social login, you consent that we may nevertheless retain and store the information that was previously shared with us.

10. Minors

Our services are not designed for or intended to be used by anyone under the age of 18. If you are under the age of 18, you may not use our Services and must exit our Site immediately. If you are a parent or guardian of a child who you believe has disclosed personal information to us, email privacy@rentbetta.com with the subject line “Delete Minor’s Information” and a description of the user’s account so that we may process your request.

11. Applicable Law

RENT BETTA and the servers we use are located within the United States of America and are subject to federal and state laws. By using our Services, you consent to the use and disclosure of your information in accordance with this privacy policy and the laws of the United States of America.

12. CCPA

Our Services are for users to find and rent an apartment within the United States of America, specifically, New York City and its surrounding environs (“NYC”). We do not offer apartment listings or other services outside of our core NYC market, and we have no listings in the State of California. As such, we are not subject to the CCPA. 13. GDPR

Our Services are for users to find and rent an apartment within the United States of America, specifically, New York City and its surrounding environs (“NYC”). We do not offer apartment listings or other services outside of our core NYC market, and we have no listings in the EU. We do not act as a controller or processor of personal data for EU citizens, and so we are not subject to the General Data Protection Regulation (EU) (“GDPR”). This Privacy Policy forms part of, and is subject to, provisions in our Terms & Conditions, available at rentbetta.com/terms

15. Amendments

We reserve the right to revise, update, or modify this Privacy Policy at any time, and these revisions will become effective immediately upon posting of the new policy on our website and services. Please review this policy whenever you visit our site and discontinue the use of our Services if you do not consent to all of its terms.
